ShiftOS is operated by Particle Storm LLC ("Particle Storm", "we", "us", "our"), a Wyoming limited liability company with its principal place of business at 1603 Capitol Ave, Suite 415 #698478, Cheyenne, WY 82001.
Our designated privacy officer is Paul Baillie, reachable at privacy@shiftarcade.com.
This policy describes how Particle Storm processes personal information in connection with:
About venues using ShiftOS: when you (a "venue") subscribe to ShiftOS, your venue is the data controller for the personal information of your customers (racers, members, event attendees) that is collected and processed in your ShiftOS instance. Particle Storm acts as the processor, handling that data on your behalf. Your own privacy policy, posted on your venue's website, governs your relationship with your customers. This policy primarily addresses (a) the personal information of venue staff who use ShiftOps, and (b) Particle Storm's role as a processor of end-user data on behalf of the venue.
A "Customer" means a venue, franchise, operator, or other business entity that licenses the ShiftOS Services. The personal information we collect from individuals authorized by a Customer to access the ShiftOps control plane includes:
Particle Storm processes this category of data only on behalf of the venue Customer. The venue determines what is collected.
We do not sell personal information. We do not rent personal information. We do not use end-user (racer) personal information for advertising targeting.
We engage a limited number of third-party service providers ("Sub-processors") to deliver the ShiftOS Services. The current list of Sub-processors, including the service each one provides, the categories of personal data each one processes, the location of processing, and the applicable transfer mechanism, is maintained at shiftos.app/sub-processors.
We provide our Customers with at least 30 days' prior written notice before engaging a new Sub-processor that will process Customer Personal Data. To subscribe to change notifications, see the notifications section of the Sub-processors page.
Particle Storm is a US company and processes personal information primarily in the United States. By using ShiftOS, you understand and acknowledge that personal information will be transferred to, stored in, and processed in the United States and other jurisdictions where we or our sub-processors operate.
Personal information processed in the United States may be subject to US laws, including laws that allow US government authorities to access information held by US companies through lawful access requests (such as the CLOUD Act). We apply the safeguards described in Section 7 to all personal information regardless of where it is processed.
Customers located in the European Union, United Kingdom, or other jurisdictions with cross-border transfer rules should review Section 11 (for Canadian customers) or contact us for transfer-mechanism documentation specific to their jurisdiction.
We protect personal information with administrative, technical, and physical safeguards proportional to its sensitivity:
No system is perfectly secure. If we determine that a breach has occurred and that there is a real risk of significant harm to affected individuals, we will notify Customers without undue delay and in any event within 48 hours of confirmation, providing sufficient information for the Customer to meet its own breach-reporting obligations.
We retain personal information only as long as necessary to provide the service, comply with our legal obligations, resolve disputes, and enforce our agreements.
Depending on where you are, you may have the right to:
End-users (racers, members) should typically exercise these rights through the venue at which they are subscribed; the venue is the controller of that data. We will support the venue in fulfilling your request. If you cannot identify the venue, contact us at privacy@shiftarcade.com and we will help route your request.
Our standard response timeline is 30 days, free of charge for the first request in any 12-month period.
The ShiftOS application uses cookies for authentication (keeping you logged in) and basic preferences. We do not use third-party advertising cookies. The shiftos.app website uses Google Analytics to understand how visitors find and use the site, and may load Google Fonts at runtime. Google Analytics sets cookies to measure visits; for visitors in the European Economic Area, the United Kingdom and Switzerland these cookies are off by default and only cookieless, aggregate measurements are sent. We do not set advertising cookies on this site. You can opt out of Google Analytics on any site with Google's browser add-on.
This section applies to individuals in Canada and to Customers operating venues in Canada.
Particle Storm processes personal information in accordance with the Canadian Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation, including British Columbia's Personal Information Protection Act, Alberta's Personal Information Protection Act, and Quebec's Act respecting the protection of personal information in the private sector (Law 25).
Our designated privacy officer for purposes of PIPEDA and provincial privacy legislation is Paul Baillie. You may contact the privacy officer at privacy@shiftarcade.com regarding any privacy matter, including complaints, access requests, and questions about cross-border processing.
Personal information of Canadian individuals is transferred to and processed in the United States. While we apply contractual and technical safeguards comparable to those required by PIPEDA, you should understand that personal information processed in the United States may be subject to US laws and lawful access requests by US government authorities (including, where applicable, requests under the CLOUD Act and similar regimes). This may differ from the legal regime that would apply if the information were processed exclusively in Canada. By using ShiftOS, you consent to this cross-border processing.
If you are located in Quebec, please contact our privacy officer before using ShiftOS in a Quebec-based venue. Quebec's Law 25 imposes additional obligations on cross-border transfers (including a privacy impact assessment) that we will work with the venue to satisfy. We may require additional contractual provisions for Quebec deployments.
Where a breach of security safeguards involving personal information of Canadian individuals occurs and presents a real risk of significant harm, we will notify the affected Customer without undue delay (and in any event within 48 hours of confirmation), enabling the Customer to meet its notification obligations to the Office of the Privacy Commissioner of Canada and affected individuals.
This section applies to individuals located in the European Economic Area (EEA), the United Kingdom (UK), and Switzerland, and to Customers operating venues in those jurisdictions.
With respect to information about Customer staff and authorized users (the people who log into ShiftOps to administer a venue), Particle Storm acts as an independent controller. With respect to end-user (racer, member, attendee) personal information that a Customer collects and processes through ShiftOS, Particle Storm acts as a processor on behalf of the Customer, which is the controller. The Customer is responsible for the lawfulness of the processing instructions it gives us, including the lawful basis on which it relies to collect end-user data.
Personal data of EEA, UK, and Swiss individuals is transferred to the United States and other jurisdictions outside the EEA/UK where we or our Sub-processors operate. We rely on the following transfer mechanisms:
If you are in the EEA, UK, or Switzerland you have the following rights, subject to the conditions set out in the GDPR / UK GDPR:
End-users (racers, members) should typically exercise these rights through the Customer (the venue) that collected the data, because the Customer is the controller. We will support the Customer in fulfilling your request. To exercise any right directly with Particle Storm in respect of Customer-staff data, contact privacy@shiftarcade.com.
Where a personal data breach (as defined in Article 4(12) of the GDPR) involving Customer Personal Data occurs, we will notify the affected Customer without undue delay (and in any event within 48 hours of confirmation), providing the information the Customer reasonably requires to meet its own notification obligations to its supervisory authority and to affected data subjects.
This section applies to California residents and supplements the rest of this policy. It is provided to comply with the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA).
In the preceding 12 months we have collected the following categories of personal information (as defined in California Civil Code §1798.140):
We do not knowingly collect "sensitive personal information" as defined under the CPRA, and we do not use any personal information for the purposes of inferring characteristics about a consumer.
We use these categories for the business purposes described in Section 4 of this policy: providing the service, billing, support, security, service improvement (aggregated and de-identified for end-user data), and legal compliance.
Particle Storm does not "sell" personal information and does not "share" personal information for cross-context behavioral advertising, as those terms are defined under the CCPA / CPRA. We have not sold or shared personal information in the preceding 12 months and have no plans to do so. Disclosures we make to the Sub-processors listed at shiftos.app/sub-processors are made under contractual restrictions consistent with the "service provider" definition in Cal. Civ. Code §1798.140(ag).
We retain each category of personal information for no longer than reasonably necessary for the purposes described in Section 8 of this policy, taking into account our contractual obligations to Customers and our legal-retention obligations.
If you are a California resident you have the right to:
To submit a request, email privacy@shiftarcade.com with "California Privacy Rights Request" in the subject line. We will verify your identity by matching information you provide against information we already hold. You may designate an authorized agent to make a request on your behalf; we will require written proof of the agent's authority and may still need to verify your identity directly.
End-users (racers, members) of a California venue should typically submit requests to that venue first, as the venue is the business that collected the data and Particle Storm acts as its service provider.
California Civil Code §1798.83 permits California residents who have an established business relationship with us to request information about our disclosure of personal information to third parties for those third parties' direct-marketing purposes. We do not disclose personal information to third parties for their direct-marketing purposes, so we have no information to provide in response to such a request.
We may update this policy from time to time. Material changes will be notified to active Customers by email and reflected on this page. The "Last updated" date at the top indicates when changes were last made. Continued use of the service after a change constitutes acceptance of the updated policy.
