This Terms of Service and Privacy Policy (“Policy”) governs how Particle Storm LLC (“we,” “our,” or “us”) collects, uses, and protects information in connection with communications initiated through our websites and platforms, including shiftOS, Sim Station, and shiftos.app.

This Policy applies to electronic communications including, but not limited to:

  • SMS (text messages)

  • Email communications

  • Web forms and software inquiries

  • Product updates and service notifications

Particle Storm LLC is a software and technology company offering venue-management software (shiftOS) and simulator solutions (Sim Station). We do not operate consumer racing venues directly.

2. Scope of This Policy

This Policy applies when an individual:

  • Submits a form on shiftos.app or another Particle Storm LLC–owned website

  • Requests information about shiftOS or Sim Station

  • Opts in to receive SMS or email communications

  • Engages with us prior to selecting or engaging with a specific venue or operator

If a customer later engages with an independently owned Shift Arcade or other venue using shiftOS, that venue’s own Terms of Service and Privacy Policy will govern reservations, payments, on-site experiences, and location-specific communications.

3. Communications & Messaging Programs

3.1 Purpose of Communications

By opting in, individuals may receive informational and service-related communications, including:

  • Responses to inquiries

  • Software demos, onboarding, or support communications

  • Product updates related to shiftOS or Sim Station

  • Operational or account-related notifications

  • Educational or informational content related to venue operations

Communications are limited to the context of the individual’s expressed interest or relationship with Particle Storm LLC.

3.2 SMS Consent & Opt-Out

By opting in to SMS communications, you consent to receive text messages from Particle Storm LLC.

  • Message frequency may vary based on engagement

  • Message and data rates may apply

  • Carriers are not liable for delayed or undelivered messages

You may opt out at any time by replying STOP to any message.

You may request assistance by replying HELP.

After opting out, you will receive a confirmation message and no further messages will be sent unless you re-subscribe.

4. Information We CollecT

We may collect the following personal information when you interact with us:

  • Name

  • Email address

  • Phone number

  • Business or venue details

  • Information voluntarily provided through forms, messages, or software inquirie

We collect only information reasonably necessary to conduct business communications, provide requested services, and support our software offerings.

  • Respond to inquiries and requests

  • Provide software information, demos, or support

  • Send service-related or account-related communications

  • Deliver product updates and operational notices

  • Improve customer experience and platform performance

  • Maintain compliance with legal and messaging requirements

We do not use personal information for unrelated marketing purposes without appropriate consent.

6. Data Sharing & Third Parties

We do not sell or rent personal information.

We may share information with trusted service providers (such as CRM platforms, email services, SMS providers, or hosting providers) strictly for business operations and communications. These providers are contractually required to protect information and comply with applicable privacy laws.

Text messaging opt-in data and consent are never shared, except with aggregators and providers necessary to deliver messaging services.

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, misuse, or disclosure. While no system can guarantee absolute security, we use commercially reasonable measures to protect data.

We comply with applicable local, state, and federal laws, including mobile messaging regulations and industry standards such as the TCPA and CTIA guidelines.
